These Terms and Conditions ("Terms") govern your use of the Atithimate mobile application and services, including bike rentals, guide bookings Tour Activities Enquiry and Tour Package Enquiry. By using our services, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By downloading, accessing, or using the Atithimate App , you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must stop using the app immediately.

2. Services Offered

Atithimate App provides services such as:

  • Bike rentals from third-party providers.
  • Tour guide booking services for various destinations.
  • Tour Package Enquiry services in house.
  • Tour Activities Enquiry services in house.

We act as an intermediary between you and the service providers (bike rental companies and guides), and we do not take responsibility for the quality of services provided by them.

3. User Responsibilities

As a user of Atithimate App, you agree to:

  • Provide accurate and complete personal information when creating an account and making bookings.
  • Comply with all applicable laws and regulations related to bike rentals and guide services in the region you are visiting.
  • Take full responsibility for any damage, loss, or injury that may occur while using rented bikes or during guided tours.
  • Ensure that you meet the minimum age (18+)requirements for bike rentals or tour services, as set by the service providers.

4. Payments

All payments for bookings made through the Atithimate app must be completed via the payment methods provided. You agree to pay all fees and charges incurred in connection with your use of the services.

Any issues related to payment disputes with third-party providers must be addressed directly with the provider.

5. Cancellations and Refunds

Cancellation and refund policies for bike rentals and guide services vary based on the specific provider. You must review the provider’s cancellation policy before booking. Atithimate App is not responsible for any cancellations or refunds handled by third-party providers.

6. Limitation of Liability

Atithimate is a platform for connecting users with bike rental and guide services. We are not liable for any injuries, losses, damages, or other claims that arise from the services provided by third parties.

We do not guarantee the availability, safety, or quality of the services offered by bike rental companies or guides.

7. User Conduct

You agree not to:

  • Use the app for any illegal or unauthorized purposes.
  • Post, transmit, or distribute any content that is harmful, offensive, or violates the rights of others.
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.

8. Changes to the Terms

We may update these Terms from time to time. Any changes will be posted within the app, and continued use of the app after such changes are posted will constitute your agreement to the updated Terms.

9. Termination

We reserve the right to terminate or suspend your access to the Atithimate app at any time, without notice, for conduct that violates these Terms or is harmful to the interests of other users or the app itself.

10. Governing Law

This Agreement shall be governed by the laws of India, and the courts of Bangalore shall have exclusive jurisdiction with respect to any dispute arising hereunder.

11. Drink And Drive Policy

According to Government Motor Vehicles Act 2016 under Section 185, a motorist caught under the influence of alcohol exceeding the permissible limit which is 30mg of alcohol in 100ml of blood is liable to be charged and the vehicle will be ceased by the City Traffic Police indefinitely. Under this circumstance, the Atithimate user will be charged with the asset cost and downtime period.

If found intoxicated at the time of booking completion, the user will be further blocked from using Atithimate services indefinitely

6. Account Deletion

  • Requesting Account Deletion: Users have the right to request the deletion of their account at any time. Requests can be made through the app's settings or by contacting our support team.
  • Process and Timing: Upon receiving a request for account deletion, we will process it within 7 business days. You will receive a confirmation once the account has been successfully deleted.
  • Data Removal: All personal data associated with the account will be permanently removed from our systems. This includes user profiles and preferences. Please note that this action is irreversible.
  • Retention of Data: In some cases, we may retain certain data if required by law or for legitimate business purposes, such as resolving disputes or enforcing agreements.

  • Force Majeure Events: Atithimate Tours and its partners are not liable to issue refunds for cancellations or interruptions due to unforeseen events (natural disasters, political events, etc.).

3. Refund Process

  • Refund Request: Users must submit a refund request through the Atithimate App or our customer support team within 7 days of the service date.
  • Verification: Upon receiving a refund request, Atithimate will conduct a review with the service provider to confirm eligibility.
  • Refund Approval: Approved refunds will be processed back to the original payment method within 7–14 business days.

4. Partial Refunds

In certain cases where only part of the service was unsatisfactory, Atithimate may provide a partial refund based on a case-by-case evaluation.

Delete Account Policy

  • Select Delete Account and follow the prompts to confirm your decision.

2. What Happens When You Delete Your Account

Upon the deletion of your account:

  • Booking History: All past and upcoming bookings (bike rentals, guide services, etc.) will be cancelled, and your booking history will be removed.

  • Non-Reversible: The deletion process is permanent and cannot be undone. If you wish to use Atithimate again, you will need to create a new account.

3. Third-Party Services

If you have used Atithimate to book services (bike rentals, tour guides) provided by third-party providers:

  • Service Provider Information: Your account deletion on Atithimate does not automatically delete any data that third-party providers may have stored. You will need to contact them directly to request the deletion of any data they may have on you.
  • Refunds and Cancellations: Any pending services or refunds will be subject to the third-party provider’s policies. We recommend resolving these issues before deleting your account.
